David has more than 30 years’ experience as a litigation lawyer. He was appointed Queen’s Counsel in 2014 and has appeared in, and provided advice in relation to, a wide range of public, commercial and criminal law proceedings.

David’s experience includes:

  • conducting general civil/commercial litigation proceedings, including those involving contract, tort, Fair Trading Act, Companies Act and equitable remedies claims;
  • proceedings challenging regulatory decisions by Independent Crown entities, including in particular those relating to the energy sector;
  • judicial review proceedings, including those: challenging government ministerial and departmental decisions; and involving public health, fisheries, Treaty of Waitangi and resource management issues;
  • appeals against decisions by various Crown Entities and disciplinary bodies;
  • civil enforcement proceedings under the Commerce Act 1986;
  • prosecuting disciplinary proceedings before a number of regulatory/disciplinary bodies;
  • intellectual property proceedings, primarily relating to trade marks;
  • prosecuting criminal trials when employed as a prosecutor with the firm of the Wellington Crown Solicitor and as a member of the Wellington Crown Prosecution Panel;
  • acting in criminal (for the Crown Law Department of the Kingdom of Tonga) and judicial review proceedings in the Kingdom of Tonga;
  • government departmental prosecutions, including those under fisheries, inland revenue, customs, companies, resource management, social welfare and health and safety in employment legislation;
  • electricity industry regulatory proceedings;
  • reviews/inquiries in respect of Crown entities.
